This page is an English adaptation of HodHod’s Terms of Use. In the event of any conflict between this version and the Arabic version, the Arabic version prevails.

Welcome to HodHod. By using the platform, you agree to these Terms of Use and our Privacy Policy. These terms constitute the legal agreement that governs your use of the platform and define your rights and obligations when using HodHod’s services.

1. Platform Services and Scope of Use

HodHod is a specialized technology platform that provides the tools to create, manage, and send newsletters. By using the service, you agree to:

  • Use the platform only for its intended purposes
  • Comply with all applicable laws, regulations, and rules
  • Respect the intellectual property and privacy rights of others

You are solely and fully responsible for all data and content published, sent, or shared through your account, including newsletter content, attachments, and the accuracy and legality of your mailing lists. HodHod bears no legal responsibility for any of this content.

2. Compliance and Lawful Use

You agree to use HodHod in accordance with applicable laws and in a way that respects the rights of others. The following are strictly prohibited:

  • Publishing content that contains hate speech, discrimination, or attacks on religions, ethnicities, nationalities, or any social group
  • Inciting violence, terrorism, or any illegal activity
  • Publishing or distributing pirated material or content that infringes intellectual property rights
  • Fraud, forgery, or using the platform for deceptive purposes
  • Publishing obscene content or content that violates public decency standards
  • Sending messages containing malware or malicious links
  • Infringing copyrights, trademarks, or other intellectual property rights
  • Publishing defamatory content or content that damages the reputation of individuals or organizations

HodHod reserves the right to remove any violating content and to suspend or terminate accounts where these terms are found to have been breached.

3. Content and Mailing List Responsibility

HodHod is a software service for managing newsletters. We do not control the content of messages published by users.

You are fully responsible for:

  • All content you send or publish through the platform
  • Ensuring you have the legal right to use the mailing lists you manage
  • Obtaining the necessary consents from contacts before sending them messages, where required by applicable law

HodHod bears no responsibility for content published through the platform or for the relationship between you and your newsletter’s subscribers.

4. Account Eligibility

To use the platform, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding agreements

When creating an account, you agree to provide accurate and complete information and to keep it up to date. HodHod reserves the right to suspend or close accounts that violate these terms.

5. Account Security and Password

You are fully responsible for maintaining the confidentiality of your account credentials, including your username and password. You are responsible for all activity that occurs under your account, whether carried out by you or resulting from your failure to protect your login details.

HodHod applies advanced technical standards to protect your data:

  • Password encryption, Passwords are never stored in plain text, they are encrypted using secure hashing mechanisms that prevent direct access.
  • Password reset, If you lose your password, the platform provides a secure process to set a new one. The support team cannot retrieve or send you your original password.
  • Immediate reporting, You must notify HodHod immediately if you suspect any unauthorized access or breach of your account.

HodHod is not liable for any damages resulting from a user disclosing their login credentials or failing to maintain the security of their account and personal devices.

6. Account Protection and Identity Verification

HodHod reserves the right to take precautionary measures to protect user security and platform stability. In cases of suspected account breach or activity that violates these terms, the following policies apply:

  • Temporary suspension: The platform may immediately suspend an account to protect associated data.
  • Identity verification: To reactivate an account, the platform may request official documents or approved verification data such as registered phone numbers, or any additional data that legally confirms the account holder’s identity.
  • Final decision: HodHod management holds the right to make the final decision on whether to reactivate or permanently close an account, based on the accuracy and validity of the information provided.

All verification documents are handled in accordance with our Privacy Policy and are used solely for security and verification purposes.

7. Account Ownership Disputes

If a dispute arises between multiple parties over the ownership of an account, HodHod reserves the right to request official documents or technical evidence proving legal ownership. The platform will review all submitted documents carefully to ensure the account is returned to its rightful owner.

If the dispute cannot be resolved through submitted documents or mutual agreement, the following procedures apply:

  • Legal recourse: Disputing parties are required to resolve the matter through the appropriate legal and judicial channels.
  • Temporary suspension: The platform may temporarily suspend the account and restrict access throughout the dispute period as a precautionary measure to protect data and prevent unauthorized modifications.
  • Judicial enforcement: The suspension will only be lifted or account ownership transferred upon a final court ruling or a written agreement documented by all disputing parties.

HodHod bears no responsibility for any damages or losses resulting from precautionary suspension measures during a dispute period.

8. Intellectual Property

You retain full intellectual property and copyright ownership of all content you publish through the platform. By using the service, you grant HodHod a limited, non-exclusive technical license to process, display, and send this content, strictly to the extent technically necessary to deliver the service and ensure your newsletter reaches your subscribers.

9. Subscriptions and Billing

HodHod uses a flexible pricing model tied to the number of subscribers on your mailing list. A free plan is available up to a defined subscriber limit. When that limit is exceeded, a paid plan is required to continue sending newsletters.

By activating a subscription, you agree to the following:

  • List capacity: You are responsible for selecting the plan that matches your subscriber count. If your list exceeds the current plan’s limit, an upgrade is required to continue sending.
  • Payment of fees: You agree to pay the fees for your chosen plan according to the selected billing cycle (monthly or annual).
  • Grace period: If a subscription renewal fails due to a payment issue, a 10-day grace period is granted. During this time, you can update your payment details and renew without service interruption.
  • Service suspension: After the grace period ends without renewal, the platform may automatically suspend access to sending services and paid plan features.
  • Payment integrity: You agree to pay subscription fees using lawful and valid payment methods. Using fraudulent, stolen, or unauthorized payment methods will result in immediate and permanent account suspension, with legal action reserved.

10. Cancellation and Refund Policy

Cancellation process: You may cancel your subscription at any time through your account settings. Your account will retain full access to all paid plan features until the end of the current billing cycle, after which it will automatically revert to the free plan without data loss.

Refund policy: Subscription fees are non-refundable once paid, except where required by law or as specified in HodHod’s Subscription and Refund Policy.

11. Account Suspension or Termination

HodHod reserves the right to temporarily or permanently suspend or close accounts in the following cases:

  • Terms violation: Violation of any clause in these Terms of Use
  • Unlawful activities: Using the platform for activities that violate applicable laws and regulations
  • Harm to others: Misusing the service in a way that causes harm to the platform or other users
  • Financial fraud: Attempting to circumvent payment systems or using unauthorized payment methods

HodHod may notify you before taking suspension action. However, the platform reserves the right to act immediately depending on the severity and nature of the violation.

12. Service Stability

We are committed to providing a stable and reliable service and continuously work to improve platform performance. In the rare cases where the service may experience a temporary interruption, due to scheduled maintenance, unexpected technical issues, or circumstances beyond our control, we will work to restore service as quickly as possible and communicate through our official channels.

HodHod does not guarantee uninterrupted service availability at all times and is not liable for losses resulting from service outages outside its control.

13. Amendments to These Terms

HodHod reserves the right to update these Terms of Use from time to time to reflect technical and legal developments. When changes are made, the updated version will be published on this page with the date of the latest revision. Your continued use of the platform after such updates constitutes your implicit acceptance of the revised terms.
